Budd reintroduces bill that would deport illegal aliens who assault police

US Sen. Ted Budd, R-NC, reintroduced the Protect Our Law Enforcement with Immigration Control and Enforcement (POLICE) Act of 2025 on Friday.

The move comes after President Donald Trump’s declaration of a national emergency at the southern border.

Thousands of illegal immigrants, including a Haitian gangster, have been deported after Trump’s first week in office.

The passage of the Laken Riley Act included an amendment requiring US Immigration and Customs Enforcement (ICE) to detain an illegal alien who assaults law enforcement.

“One of the best ways we can support law enforcement officers, and protect the public is by deporting dangerous people who do them harm,” Budd said in a press release. “If a migrant commits the crime of assaulting an officer or other first responder, they should be subject to immediate deportation. Our lawmakers must always back the men and women who protect and serve our communities. We must act on this vital proposal.”

The POLICE Act would further strengthen federal law by explicitly making assault of a law enforcement officer, firefighter, or other first responder a deportable offense.  

Budd led the POLICE Act in the 118th Congress and twice pushed for its passage in the Senate.

In a March speech on the Senate floor, he said the country was in the middle of the worst border crisis in US history.

“The story of this crisis is one of preventable tragedies compounding day after day,” Budd said. “And sadly, we’ve seen it in North Carolina less than two years ago, when Wake County Deputy Sheriff Ned Byrd was killed in the line of duty. He was murdered by illegal aliens who should have never been in this country.”

Byrd was killed in August 2022 by brothers Arturo Marin-Sotelo and Alder Alfonso Marin-Sotelo from Mexico. Alder escaped prison in Virginia in April 2023 and fled to Mexico, where he is fighting extradition to the US.

Budd added that any senator who claimed to support the police should have no problem supporting his amendment, which would have attached the POLICE Act to a partial government funding package.

Both times, he was blocked by the former Democrat Senate majority.

The 2025 bill is co-sponsored by Republican Senators Thom Tillis, R-NC, Steve Daines, MT, Katie Britt, AL, Ted Cruz, TX, Eric Schmitt, MO, Bill Hagerty, TN, James Lankford, OK, Roger Marshall, KS, Cindy Hyde-Smith, MS, Kevin Cramer, ND, Jim Justice, WV, and Tim Sheehy, MT. 

The House bill, H.R. 31, is led by Rep. Andrew Garbarino, R-NY.
